Multiple DWI Charges Attorney in South Jersey
New Jersey Criminal Defense Lawyer Fights to Mitigate the Consequences of Multiple DUI Charges in Burlington County, Camden County and Throughout NJ
Driving while under the influence of alcohol or drugs (DUI) is an extremely serious offense in New Jersey under any circumstances. When you are charged with DUI for a second or subsequent time, however; the penalties become significantly more severe. New Jersey courts are far less likely to show leniency in their sentencing once you have been arrested on DUI charges for a second or subsequent time. In almost every case involving multiple DUIs, you will be facing mandatory jail time, loss of your driver’s license and substantial monetary penalties. The bottom line is that while every single arrest and charge should be taken seriously, if you’re facing DUI charges for a second or third time, it is vital to get the advice of a skilled multiple DUI defense lawyer.

New Jersey Imposes Significant Penalties for Second or Subsequent DUIs
New Jersey’s penalty system for DUIs is tiered, meaning that the range of penalties increase according to the number of DUIs involved and your blood alcohol content (BAC) level. The amount of time between DUI offenses will determine whether your case will involve multiple DUIs. This timeframe is ten years—meaning that if you have had more than one DUI conviction within the last ten years, you will risk the penalties associated with second and subsequent DUIs. For second-time DUI offenders, the penalties may include:
- A two-year license suspension,
- Between two and 90 days in jail,
- Participation in the Intoxicated Driver Resource Center program for 12-48 hours,
- Up to $1,000 or more in fines,
- Installation of an ignition interlock device.

For third or subsequent offenders, the penalties become even more serious and include:
- A ten-year license suspension,
- 180 days in jail,
- Participation in the Intoxicated Driver Resource Center program for 12-48 hours,
- $1,000 or more in fines,
- Installation of an ignition interlock device.
Multiple DUI offenders will also face insurance surcharges of $1,000 (second offenders) or $1,500 (third offenders) per year for a three-year period, and, like others who have been convicted on DUI charges, will likely pay significantly more for car insurance for the foreseeable future. In reality, the monetary fines associated with multiple DUI charges can rise to between $4,000 and $6,000, not even considering the higher insurance costs you will face.

Frequently Asked Questions About Multiple DUI Charges in New Jersey
An ignition interlock device is a device installed in your vehicle, or vehicles that you use, that prevents the car from starting unless you blow into a breathalyzer to confirm you have not been drinking. If you have been convicted of a second DUI, you will have to have one for the time your license is suspended (two years) and for third or subsequent offenders, the device will need to be installed during the ten-year suspension period and for between one and three years after you get your license back. You are also required to pay for this device.
The advice of an experienced and reputable multiple DUI defense lawyer can make all the difference in your case. For example, our defense strategy could include the suggestion of alcohol rehabilitation, which could cut your mandatory jail sentence in half. Additionally, we may be able to challenge the prosecution’s evidence in the current case or even in your first-offense DUI case so that the heightened penalties would not apply. There are many strategies that we can use to mitigate the consequences of a multiple DUI charge or even have the charges against you dropped in some cases.
